Time-Limited Waiver for Hospital-Based Detoxification Services

March 12, 2018 - On March 2, the New York State Department of Health (DOH) and Office of Alcoholism and Substance Abuse Services (OASAS) published Dear Administrator Letter (DAL) 18-05 on the availability of time-limited waivers for providers seeking to treat individuals requiring hospital-based detoxification services.

The DAL clarifies existing certification requirements and provides guidance on regulatory flexibility to increase access to addiction treatment. Existing OASAS Certification Requirements
New York State Mental Hygiene Law and regulation require OASAS certification when operating a discrete chemical dependence services unit of five beds or greater than 10% of overall patient days of an Article 28-licensed hospital.

New Regulatory Flexibility and Waiver
OASAS will provide Article 28 hospitals with a time-limited waiver to operate more than five chemical dependence services beds or greater than 10% of overall patient days without requiring an OASAS operating certificate. Waivers will be valid until December 31, 2018, at which point OASAS and DOH will review need to continue a waiver.

Reimbursement Guidance
Detoxification services provided in a medical/surgical bed are reimbursed via an acute payment APR-DRG methodology. Please see the DAL for additional reimbursement guidance.
